Abstract

The authority and legitimacy of nation-states have changed, and national governments are becoming powerless, irrelevant and unable to control the events happening within their own borders. A particular area, as a component of a given state action, loses its legal and practical significance as well as its importance as a geographical “place of action”. The loss of po er of the state allo s for legal uncertainty within the state which is at the same time a direct threat to peace, at regional and global level. Article 39 of the United Nations Peace Charter commits all United Nations peacekeepers in the following words: “The Security Council shall determine the existence of any threat to peace, disturbance or aggression and make recommendations or decide what action shall be taken in accordance with Article 41; 42. for the maintenance or establishment of international peace and security.
The war could only be justified like of „self-defence“, and in practice we have: pro-democratic intervention, intervention to protect own citizens and humanitarian intervention. When the state can convince the Interntional community that the war is only choice for defence own citizens and theritory – the war is „just war“.
